Driving a Lemon?
What Is the Lemon Law in California?
California’s Lemon Law is formally known as the Song-Beverly Consumer Warranty Act.
The Lemon Law in California protects consumers when a manufacturer fails to timely fix a vehicle that is still under warranty. If repeated repair attempts don’t solve the problem, or your vehicle spends too many days in the shop, you may be entitled to a buyback, a replacement vehicle, or cash compensation. This can apply even if the manufacturer keeps trying to repair the problem, only fixes it temporarily, or insists the issue is “normal.”
Many people don’t realize that they have the right to hire a Lemon Law attorney, and that the manufacturer is required to pay the attorney’s fees and costs when the case is successful under California Civil Code §1794(d). That’s where we come in.
What Are the Requirements for a Vehicle to Be Considered a Lemon Under the Law?
Every case is unique, but some common benchmarks include:
- Two or more repair attempts for the same safety-related defect
- Four or more repair attempts for the same non-safety defect
- Or at least 30 total days out of service for warranty repairs
There are also important exceptions that may still qualify a vehicle even if it doesn’t fit into these categories. Contact us to determine whether your situation meets the legal standards.
Which Vehicles Are Eligible?
California Lemon Law protections may apply to:
- Cars and trucks
- Motorhomes
- Boats
- Trailers
- Motorcycles
- ATVs and UTVs
What Should I Do if I Feel My Vehicle Is a Lemon?
If you suspect your vehicle may be a lemon, taking the right steps early can make a meaningful difference in protecting your rights and strengthening your case. Here’s what you can do:
- Call or text us to discuss what’s happening and get clear answers in minutes
- Continue bringing your vehicle in for warranty repairs whenever problems occur
- Request a repair order after every visit and keep a copy for your records
- Review each repair order carefully to ensure all complaints are listed and accurate
- Document everything related to your vehicle’s issues, repairs, and downtime
You don’t have to go up against multi-billion-dollar manufacturers alone. They have teams of attorneys covering their behinds. You should have a team to protect you as well.
What Could I Be Entitled to Under the California Lemon Law?
Depending on your case, you may be entitled to:
- Receive a buyback, so the manufacturer repurchases your vehicle and reimburses you for what you’ve paid, including your down payment, monthly payments, and other eligible costs.
- Keep your vehicle and receive cash compensation for the diminished value and ongoing problems, allowing you to stay in the car while being paid for the defects.
- Obtain a replacement vehicle of comparable value, giving you a fresh start.

Isn’t It Expensive for Someone to Hire an Attorney?
No. Our help costs you nothing.
California law requires manufacturers to pay your attorney’s fees and costs when a case is successful. Unlike some firms, we do not charge anything up front. We front the time. We front the costs. If we win, the manufacturer pays. If we don’t, you don’t receive a bill.
No fees. No costs. No bull.
Do Used Vehicles Qualify?
A used vehicle may qualify if it was purchased with a manufacturer’s warranty and the problems occurred and were repaired under that warranty. Call us to discuss your specific situation.
What if I Leased My Vehicle?
Leased vehicles receive the same warranty protections as purchased vehicles. Let us know your lease end date, since pursuing a claim can become more difficult if you no longer have possession of the vehicle.
What Information Is Important on a Repair Order?
Accurate repair orders help establish how many attempts were made and how long your vehicle was out of service.
Make sure the repair order shows:
- The exact drop-off date and pick-up date
- All issues you reported to the service advisor
- A clear description of your complaint in your own words (not the dealership’s)
I’ve Taken My Vehicle in Several Times, but Don’t Have Repair Orders. What Can I Do?
You may be able to request your full repair history from the dealership. Our team can also guide you through gathering records and identifying other ways to document your repair visits.
How Will a Lemon Law Case Affect My Relationship With My Local Dealership?
We are not against dealers or manufacturers in general. We’re against fraud and warranty violations. In most cases, we pursue claims against the manufacturer, not the dealership.
Since our case is against the manufacturers, you can usually continue servicing your vehicle at the same location without any negative impact on your relationship. In fact, many service writers and technicians are just as frustrated as you are. They see the problems. They document the issues. But they’re often stuck waiting on manufacturer authorization that never comes. So if you’re frustrated, don’t take it out on them: contact us and go after the manufacturer instead.
How Long Will It Take to Resolve My Case?
Every case is different. Some resolve in a few months. Others take longer, especially when certain manufacturers choose to fight harder. We won’t tell you what you want to hear: we’ll tell you the truth, what to expect, and how we can move it forward efficiently.
